These Terms & Conditions (“Terms”) govern your access to and use of wearsuninsoles.com, the WearSun foot-scanning experience, and other products and services provided by WearSun LLC (“WearSun,” “we,” “us,” or “our”) (collectively, the “Services”).

Please read these Terms carefully. By accessing or using our Services, creating an account, submitting information through our Services, or purchasing a WearSun product, you agree to these Terms.

If you do not agree to these Terms, you should not use the Services.

1. About WearSun

WearSun LLC designs and sells customized consumer insoles.

WearSun is not a healthcare provider, medical clinic, pharmacy, or medical service. WearSun does not provide medical diagnoses, prescriptions, medical treatment, or emergency medical services.

Our products are designed as consumer products based on information you provide, including foot measurements, scans, fit preferences, intended use, and other customization information.

2. Eligibility and Use of the Services

You must be legally capable of entering into a binding agreement to purchase products or create an account through the Services.

Our purchasing process, account features, product questionnaires, and foot-scanning experience are intended to be used by adults.

If you purchase a WearSun product for a child, you represent that you are the child's parent or legal guardian, or that you are otherwise authorized by the parent or legal guardian to purchase the product and provide information regarding the child.

Children under 13 should not independently create accounts, place orders, complete product questionnaires, submit foot scans, or otherwise provide personal information to WearSun.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

3. Accounts and Information You Provide

Certain features of the Services may require you to create an account or provide personal or product-customization information.

You agree to provide information that is accurate and reasonably complete.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to notify WearSun if you become aware of unauthorized access to your account.

WearSun is not responsible for losses resulting from your failure to reasonably protect your account credentials.

4. WearSun Foot Profile

To create customized insoles, WearSun may create a WearSun Foot Profile based on information you provide.

Your Foot Profile may include:

• 3D foot scans

• Foot measurements

• Foot shape and geometry

• Shoe and footwear information

• Intended product use

• Fit and comfort preferences

• Product-customization responses

• Customized insole design information

Your Foot Profile may be retained so that WearSun can manufacture your initial order, provide customer support, assist with product adjustments, and enable future reorders.

Your Foot Profile is created for the purpose of designing and manufacturing WearSun consumer products. It is not a medical record and is not intended to provide a medical diagnosis.

5. Foot Scanning

Certain WearSun products require you to complete a foot scan.

You agree to follow the scanning instructions provided through the WearSun scanning experience.

The accuracy of a customized product depends in part on the quality and accuracy of the scan and other information you provide.

If a scan appears incomplete, inaccurate, corrupted, or unsuitable for product design, WearSun may ask you to repeat the scan before manufacturing your product.

Submission of a scan does not guarantee that every scan will be technically usable.

WearSun may use third-party technology providers to process foot scans and measurements as described in our Privacy Policy.

6. Product Customization Information

WearSun may ask questions about your intended use, footwear, fit preferences, comfort preferences, or areas of pain or discomfort in order to better customize your product.

You are responsible for providing information that you believe is accurate and relevant.

The information you provide is used to help customize the requested product and is not used by WearSun to diagnose a medical condition or prescribe treatment.

If you have a medical concern, injury, significant or persistent pain, or another condition requiring medical advice, you should consult an appropriately qualified healthcare professional.

7. Product Orders

All orders are subject to acceptance by WearSun.

After you place an order, you may receive an electronic confirmation. An order confirmation acknowledges that we received your order but does not necessarily constitute final acceptance of the order.

We reserve the right, where permitted by law, to reject or cancel an order for reasons including:

• Product or pricing errors

• Suspected fraud or unauthorized payment activity

• Incomplete or unusable customization information

• Inability to manufacture the requested product

• Violation of these Terms

• Product availability or technical limitations

If we cancel an order after payment has been collected and no product has been provided, we will issue any refund required by applicable law and our policies.

8. Customized Products

WearSun insoles are individually manufactured using information associated with your Foot Profile.

Because feet, footwear, activity, and personal preferences vary, customized products may feel different from previous insoles, footwear, or orthotics you have used.

Minor differences in appearance, finish, structure, surface characteristics, or manufacturing presentation may occur as part of the customized and 3D-printing process and do not necessarily indicate a defect.

Product photographs, renderings, illustrations, and colors displayed on the website are provided for reference. Actual products may vary slightly due to screen settings, manufacturing processes, materials, or customization.

9. Prices and Payment

Prices displayed on the Services are shown in the currency indicated at checkout and are subject to change.

The price applicable to your purchase is the price displayed when you place your order, subject to correction of obvious errors where permitted by law.

Applicable sales taxes, shipping charges, or other charges will be displayed where required before completion of your order.

Our online store is operated using Shopify, and we use Shopify Payments and related payment services to process payments.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable payment provider to charge the amount shown at checkout.

10. Promotions, Discounts, and Gift Cards

From time to time, WearSun may offer promotional codes, discounts, sales, or other promotions.

Unless otherwise stated:

• Promotions may not be combined

• Promotions have no cash value

• Promotions may be limited to particular products or customers

• WearSun may establish expiration dates or usage limits

• Promotions may not be applied retroactively to completed purchases

WearSun may modify or end a promotion where permitted by law.

Gift cards are subject to any additional terms provided at the time of purchase or use and applicable law.

11. Mobile Terms of Service

The WearSun mobile message service (the "Service") is operated by WearSun (“WearSun”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to WearSun’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of WearSun through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with WearSun. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18442379740 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other WearSun mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.

12. Shipping and Delivery

Shipping times and delivery estimates displayed on the Services are estimates unless expressly stated otherwise.

For customized products, production or delivery estimates may begin only after WearSun receives all information reasonably necessary to manufacture the product, including a usable foot scan where required.

Delivery times may be affected by factors outside WearSun's reasonable control, including carrier delays, weather, customs, incorrect address information, or other disruptions.

You are responsible for providing an accurate shipping address.

WearSun's current shipping terms are described in our Shipping Policy.

12. Refunds, Adjustments, Returns, and Warranty

WearSun maintains a separate Refunds, Adjustments, Returns & Warranty Policy that explains the terms, eligibility requirements, procedures, limitations, and other conditions applicable to refunds, returns, fit adjustments, remakes or replacements, satisfaction guarantees, and product warranties.

Please review that policy before purchasing a WearSun product.

Because WearSun products are customized using information specific to each customer, the terms applicable to customized products may differ from those applicable to standard, non-customized retail products.

Nothing in these Terms limits any rights that cannot lawfully be waived under applicable consumer-protection law.

13. Reorders

Where available, WearSun may allow you to purchase additional customized insoles using an existing Foot Profile and product design without completing a new scan.

WearSun may require a new scan or updated information if:

• Your existing scan is unavailable or has been deleted

• Your measurements or footwear needs have changed

• Your existing information is no longer technically suitable

• You request a materially different product

• WearSun reasonably determines that updated information is necessary to produce the requested product

If you request deletion of your Foot Profile or associated scan/design information, WearSun may no longer be able to manufacture future pairs from the previous design.

14. Children's Products

WearSun may offer products intended for children.

A parent or legal guardian should manage the purchase, customization questionnaire, scanning process, and related communications for a child.

By providing information about a child, you represent that you are authorized to provide that information and request the customized product on the child's behalf.

Information regarding children is handled as described in our Privacy Policy and Consumer Health Data Privacy Policy.

15. Product Use and Important Disclaimer

WearSun products are consumer products designed for personal use.

WearSun does not represent that its products will diagnose, cure, treat, or prevent any disease, injury, or medical condition.

Any descriptions of support, comfort, performance, pressure distribution, alignment, activity, or similar product characteristics are intended to describe the design and intended consumer use of the product and are not a substitute for professional medical advice.

Individual experiences and results may vary.

If you experience significant pain, injury, numbness, skin irritation or damage, or another concerning reaction while using a WearSun product, discontinue use and consult an appropriate healthcare professional if necessary.

If you have a medical condition, serious injury, circulation problems, loss of sensation, or another condition that may affect safe use of insoles, consider consulting an appropriate healthcare professional before use.

16. Intellectual Property

The Services and their contents are owned by or licensed to WearSun and are protected by applicable intellectual-property laws.

This may include:

• WearSun names and trademarks

• Logos

• Website design

• Text

• Photographs

• Graphics

• Videos

• Product images and renderings

• Software and application interfaces

• Scan workflows

• Product designs

• Customized design processes

• Written materials

Subject to these Terms, WearSun grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

You may not copy, reproduce, distribute, sell, modify, reverse engineer, scrape, exploit, or commercially use WearSun content, technology, or intellectual property without our prior written authorization, except where applicable law expressly permits such activity.

17. Your Content

If you submit photographs, feedback, reviews, testimonials, messages, or other content to WearSun, you retain any ownership rights you may have in that content.

You grant WearSun a non-exclusive right to use content as reasonably necessary to:

• Provide customer support

• Fulfill your request

• Operate the Services

• Investigate product or account issues

WearSun will not use identifiable customer photographs, testimonials, or similar user-generated content in public marketing materials without appropriate permission where required.

18. Reviews and Feedback

If you voluntarily submit a review or feedback for publication, you grant WearSun a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that review or feedback in connection with WearSun's business and marketing, subject to applicable law.

You represent that content you submit does not knowingly infringe another person's intellectual-property, privacy, or other rights.

WearSun may decline to publish or may remove content that violates these Terms or applicable law.

19. Prohibited Uses

You may not use the Services to:

• Violate applicable law

• Engage in fraud or deceptive conduct

• Impersonate another person

• Submit false payment information

• Attempt unauthorized access to systems or accounts

• Introduce malware or harmful code

• Interfere with the security or operation of the Services

• Scrape or harvest data through unauthorized automated means

• Copy or exploit WearSun intellectual property without permission

• Use the Services in a manner that harms WearSun, our customers, or third parties

We may restrict or terminate access where reasonably necessary to protect the Services or enforce these Terms.

20. Third-Party Services and Links

The Services may rely on or link to third-party platforms, including Shopify, payment providers, shipping providers, analytics services, social media services, or other technology providers.

WearSun does not control independent third-party services, and use of those services may be subject to their own terms and privacy policies.

We are not responsible for independent third-party websites or services except to the extent required by applicable law.

21. Availability of the Services

We attempt to keep the Services available and functioning properly but do not guarantee uninterrupted or error-free operation.

We may modify, suspend, update, or discontinue features where reasonably necessary.

We are not responsible for temporary interruptions caused by maintenance, internet outages, third-party providers, equipment failures, security incidents, or other circumstances outside our reasonable control.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis.

Except for any express warranty or guarantee provided in our Refunds, Adjustments, Returns & Warranty Policy, and except for rights that cannot lawfully be excluded, WearSun disclaims implied warranties to the maximum extent permitted by law.

Nothing in these Terms excludes or limits warranties, remedies, or consumer rights that cannot legally be waived.

23. Limitation of Liability

To the maximum extent permitted by applicable law, WearSun will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of the Services or products.

To the maximum extent permitted by applicable law, WearSun's aggregate liability arising out of a particular purchase will not exceed the amount you paid to WearSun for the product giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be excluded or limited.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless WearSun LLC and its officers, employees, and agents from third-party claims arising from:

• Your unlawful use of the Services

• Your material violation of these Terms

• Content you submit that infringes another person's rights

This section does not require you to indemnify WearSun for WearSun's own unlawful conduct.

25. Disputes

Before initiating formal legal proceedings, you and WearSun agree to make a reasonable effort to resolve disputes informally.

You may contact hello@wearsuninsoles.com with a description of the issue and the resolution you are requesting.

Nothing in these Terms prevents either party from exercising rights or remedies available under applicable law.

26. Electronic Communications

By using the Services, you agree that communications, agreements, notices, and other records may be provided electronically where permitted by law.

Marketing emails and text messages remain subject to the separate consent and opt-out requirements described in our Privacy Policy and applicable law.

27. Changes to These Terms

We may update these Terms periodically to reflect changes to our products, Services, business practices, or applicable law.

The “Last Updated” date above indicates when these Terms were most recently revised.

Material changes will apply prospectively as required by applicable law.

Your purchase of a product is governed by the version of the applicable commercial terms and policies in effect when the purchase is made, except where otherwise permitted or required by law.

28. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

29. Entire Agreement

These Terms, together with any policies expressly incorporated by reference—including our Privacy Policy, Consumer Health Data Privacy Policy, Refunds, Adjustments, Returns & Warranty Policy, and Shipping Policy—constitute the agreement between you and WearSun concerning your use of the Services and applicable purchases, except where another written agreement expressly applies.
